Terms of Service
These terms are the agreement between you and Ankit Paudel ("we", "us") for the Himova mobile app and its online service. By creating an account and ticking the box, you agree to them and to our Privacy Policy.
1. Who can use Himova
You must be 18 years old or older. We ask for your date of birth when you sign up and do not create accounts for anyone younger. If you give a false date of birth, or we learn you are under 18, we may close your account and delete your data.
2. Your account
- Give accurate information and keep your password safe. You are responsible for what happens under your account.
- One person per account. Tell us straight away at imankit.paudel@gmail.com if you think someone else has accessed it.
- Gym accounts are set up by us for a gym and are also covered by our agreement with that gym.
3. Wellness information, not medical advice
- Speak to a doctor or registered dietitian before starting or changing an exercise or eating plan, especially if you have a health condition, are pregnant, are recovering from injury, or have a history of disordered eating.
- Stop exercising and get help if you feel pain, dizziness or unwell. You exercise at your own risk.
4. Allergens and food data
Allergen filtering and food information are conveniences, not guarantees. Food data comes from public and third-party databases and can be incomplete or out of date, and products change. Always read the label and check ingredients yourself. Do not rely on the app if an allergic reaction could be serious.
5. Community content
There is no tolerance for objectionable content or abusive users. Gym communities let members post text, photos, comments, polls and reactions. You are responsible for what you post. You must not post anything that is unlawful, threatening, harassing, hateful, sexually explicit, or that violates someone's privacy or rights, and you must not impersonate others or share other people's health information. Photos must be yours to share.
- You keep ownership of your content and give us and your gym's community a limited licence to store and display it in the app for as long as it is posted.
- Gym staff and we may remove content or members that break these rules.
- Reporting and blocking. Report a post, comment or member from the ⋯ menu (or by pressing and holding a name on a leaderboard). Reports are reviewed by your gym and by us, and we act on them promptly: we remove content that breaks these rules and can remove members who post it. You can also block a member: you will no longer see each other's posts or comments. Manage the members you have blocked in Profile. You can always email imankit.paudel@gmail.com to report a problem.
6. Acceptable use
Do not attempt to break, overload, reverse-engineer or gain unauthorised access to the service, scrape it, or use it for anything unlawful.
7. Ending your account
You can stop using Himova at any time and delete your account and data in the app (Profile → Account → Delete account) or by emailing imankit.paudel@gmail.com (see the deletion page). We may suspend or close accounts that break these terms.
8. Our content and third-party material
The app, its design and its exercise and food libraries belong to us or our licensors. Some open-source and public data is used under its own licences, listed in the app under Profile → About & legal.
9. Availability and changes
We work to keep the service running but do not promise it will always be available or error-free. We may change or discontinue features. If we change these terms or the Privacy Policy in a way that matters, we will publish a new version and ask you to accept it before you continue.
10. Liability
The service is provided "as is". To the fullest extent the law allows, we are not liable for indirect or consequential loss, or for injury or loss arising from your reliance on estimates or food information, and our total liability to you is limited to the amount you paid us in the 12 months before the claim (currently nothing). Nothing here limits liability that cannot lawfully be limited.
11. Governing law
These terms are governed by the laws of Nepal, and the courts of Nepal have jurisdiction, without affecting any consumer rights you have under the law of the country where you live.
